The Munich Higher Regional Court ruled that comprehensive insurance does not cover damage sustained while a stuck motorhome is being towed out. The owner had driven onto muddy ground, the vehicle sank and a tractor attempted to pull it free. During the tow the driver applied extra throttle and the motorhome hit the tractor because the brakes gripped poorly. The court found that the forces causing the collision came from the motorhome's own drive and the towing process, not from an external impact, so the incident was not an insured accident. The disputed amount was around 10,300 euros and the insurer's appeal was upheld.
