CBP Proposes Permanent Suspension of De Minimis Duty Exemption

On June 23, U.S. Customs and Border Protection published two proposed rules establishing a new legal basis for indefinitely suspending the de minimis duty exemption for low-value imports. Instead of relying on the International Emergency Economic Powers Act, which faces legal challenges, CBP cites its authority under the Tariff Act of 1930 to limit tariff exemptions independently. For the RV industry, this is a positive development as it makes the suspension less likely to be overturned in court, supporting fairer competition for U.S. manufacturers. The rules take effect July 24 for packages entering through the international postal network, unless modified.
